These Terms govern access to Ridezee websites, applications, booking interfaces, kiosks and related rider services.
By creating an account, accepting these Terms, requesting transportation and using transportation arranged through Ridezee, a user agrees to these Terms.
Nothing in these Terms limits a consumer right, privacy right and legal remedy that cannot lawfully be limited.
1. Ridezee’s Role
Ridezee is operated by Blackwell Holdings B.V., doing business as Ridezee.
Unless expressly stated for a particular market, Ridezee operates a technology platform connecting riders with participating local transportation providers.
The transportation provider, not Ridezee, supplies the transportation service and controls the physical operation of the vehicle.
Transportation providers remain responsible for their driving, vehicles and legally required licenses, permits and insurance.
Ridezee may apply verification and safety standards appropriate to each market. Requirements and verification procedures vary by location.
2. Eligibility and Accounts
- A user must be at least 18 years old and legally capable of entering a contract to create a rider account.
- A minor may travel only with a parent, guardian and responsible adult unless Ridezee expressly offers a legally approved program for unaccompanied minors.
- Account, contact, booking and payment information must be accurate.
- Accounts and verification codes must not be sold, transferred and shared.
- Suspected unauthorized account access must be reported promptly.
- Ridezee may request identity, telephone and payment verification.
3. Ride Requests
- Immediate and scheduled requests may be offered depending on the market.
- A scheduled request is not confirmed until accepted by a transportation provider.
- Pickup times, arrival times, routes and trip durations are estimates.
- Availability may be affected by demand, traffic, weather, communications coverage, government rules, airport procedures and port procedures.
- Riders must provide accurate pickup, destination, passenger, luggage and accessibility information.
- Before entering the vehicle, riders should compare the driver, vehicle and license plate with the information displayed in Ridezee.
4. Bookings for Other People
- A user may book for another person only with that person’s authorization.
- The booking user must provide accurate information and deliver the applicable trip and safety notices to the passenger.
- The booking user remains responsible for authorized charges and guest conduct to the extent permitted by law.
- A booking user cannot provide recording consent for another competent adult.
5. Fares, Fees and Taxes
- Applicable fares, booking fees, service fees, convenience fees, taxes and other charges will be displayed through Ridezee and the applicable market terms.
- A quoted fare may be an estimate unless identified as fixed.
- Final charges may reflect legally permitted waiting time, rider requested stops, tolls, airport charges, port charges, taxes, cleaning and damage.
- Government regulated fares control where applicable.
- Tips are voluntary unless clearly stated otherwise.
- Promotions and account credits are subject to their stated conditions.
6. Payments
- Riders authorize Ridezee, its bank and its payment processor to charge the selected payment method for properly disclosed amounts.
- A temporary authorization hold may be placed when transportation is requested.
- An authorization hold is not necessarily a completed charge.
- Release timing is controlled by the financial institution that issued the payment method.
- Ridezee does not retain complete payment card credentials.
- Ridezee may receive masked card information, processor tokens and transaction status.
- Riders remain responsible for unpaid amounts.
- Payment disputes may be sent to info@ridezee.com.
7. Cancellations, Waiting and No Shows
- Cancellation fees may apply after a transportation provider accepts a request, begins travelling to pickup, arrives and waits beyond a disclosed period.
- The applicable fee and triggering event must be displayed before booking and through market specific terms.
- A transportation provider may cancel when the rider cannot be located, cannot be contacted, exceeds vehicle capacity, requests unlawful transportation and presents a legitimate safety concern.
- When no transportation provider is found, an unused payment authorization will be released subject to bank processing time.
8. Rider Conduct
Riders and guests must:
- Treat drivers, other passengers, Ridezee personnel and members of the public respectfully.
- Avoid discrimination, harassment, threats, sexual misconduct and violence.
- Follow applicable seat belt, child restraint and passenger capacity laws.
- Avoid interfering with the driver’s operation of the vehicle.
- Avoid illegal drugs, unlawful weapons, hazardous materials and criminal activity.
- Avoid smoking and vaping unless expressly permitted by the driver and applicable law.
- Avoid damaging and excessively soiling the vehicle.
- Avoid asking a driver to violate traffic, fare, licensing and safety rules.
- Avoid unlawful recording, publication and use of another person’s information.
- Take responsibility for guests travelling under the booking.
Ridezee may review cleaning and damage charges using available evidence and provide the rider a reasonable method to dispute the charge.
9. Safety and Emergencies
- Ridezee safety tools support riders and drivers but do not replace professional judgment and local emergency services.
- In an immediate emergency, contact the applicable local emergency service first.
- Ridezee is not an emergency dispatch provider.
- Riders should not assume that Ridezee support is monitoring a trip in real time.
10. Safety Audio Recording
- Ridezee may offer optional safety audio recording in selected markets.
- The approved driver phone makes the recording.
- The requesting rider will receive a separate consent request on the rider’s phone before recording begins.
- Acceptance of these Terms is not consent for a specific recording.
- Recording must not begin until every notice and consent required by applicable law has been completed.
- The applications must display a clear recording indicator.
- Affirmative consent applies only to the disclosed trip and recording type.
- A person may consent for themselves and a minor whom they are legally authorized to represent.
- A person cannot consent for another competent adult.
- The booking rider must inform accompanying passengers that recording has been requested.
- Declining recording does not itself violate these Terms.
- Consent may be withdrawn. The recording must stop as soon as reasonably practical and safe.
- Previously collected material may be retained when reasonably necessary for an incident, legal claim, insurance matter, regulatory obligation and documented legal hold.
- Recordings may be reviewed for safety incidents, complaints, disputes, fraud, insurance matters, legal claims and lawful government requests.
- Recordings are not intended for advertising, public posting and biometric identification.
- Unless separately disclosed, recordings are not monitored live.
- The feature does not contact emergency services.
- Technical conditions may affect whether a recording starts, continues and captures a complete incident.
- Riders must comply with applicable law when making independent recordings outside the Ridezee feature.
11. Location and Trip Information
Ridezee processes location and trip information to identify pickup, locate available providers, operate trips, calculate charges, display trip status, provide support and operate safety features.
Location may be collected while a request and trip are active, including in the background when the required device permission has been granted.
Disabling location may limit functionality.
12. Lost Property
Ridezee may assist communication between a rider and transportation provider concerning lost property.
Recovery is not assured. A disclosed return fee may apply when legally permitted.
13. Off Platform Arrangements
Transportation arranged directly with a provider outside Ridezee is not a Ridezee trip.
Ridezee payment processing, trip records, support and safety features may not apply.
Riders must not use information obtained through Ridezee to bypass applicable platform requirements.
14. Electronic Communications
Ridezee may send verification codes, booking confirmations, arrival notices, receipts, account alerts, safety notices and support communications through the app, email, telephone, push notification and SMS.
Message and data rates may apply.
Reply STOP to eligible SMS messages to stop those messages. Marketing communications may also be stopped through the supplied unsubscribe method.
Electronic acceptance and records have the effect permitted by applicable law.
15. Acceptable Use and Intellectual Property
Ridezee grants users a limited, personal, revocable, nonexclusive license to use the platform for lawful transportation purposes.
Users must not:
- Copy, resell and commercially exploit Ridezee technology.
- Scrape, data mine and reverse engineer the platform except where law expressly permits.
- Interfere with security, pricing, dispatch and location systems.
- Introduce malicious code.
- Impersonate another person.
- Create fraudulent trips and accounts.
- Manipulate payments, promotions, ratings and location information.
Ridezee and its licensors retain ownership of the platform, software, designs, databases, logos and trademarks.
16. Ratings, Reviews and Content
Content submitted to Ridezee must be truthful, lawful and based on genuine experience.
Users retain ownership of their content and grant Ridezee a nonexclusive license to host and use it for operating and improving the platform.
Content submitted for public display may be displayed publicly. Ridezee may remove content violating these Terms and applicable law.
17. Account Restriction and Termination
Ridezee may restrict, suspend and terminate access when reasonably necessary to address fraud, unpaid charges, unlawful conduct, safety risks, false reports, misuse of information, repeated policy violations and legal requirements.
Where practical and legally appropriate, Ridezee will provide notice and a method to contact support.
18. Third Party Services
Ridezee may use mapping, payment, communications and other third party services governed by separate terms and privacy notices.
19. Service Availability and Disclaimers
To the fullest extent permitted by law:
- Ridezee technology is provided on an available basis.
- Uninterrupted access, continuous network coverage and transportation provider availability are not promised.
- Pickup times, routes and arrival times are estimates.
- Transportation involves risks that technology cannot eliminate.
- Ridezee is not responsible for a transportation provider’s acts outside Ridezee’s role as a technology platform, except where liability cannot lawfully be excluded.
- Mandatory statutory warranties and consumer protections remain unaffected.
20. Limitation of Liability
To the fullest extent permitted by law:
- Ridezee is not liable for indirect, incidental, special, exemplary, punitive and consequential damages.
- Ridezee’s total liability will not exceed the greater of US $100 and the service fees paid directly to Ridezee during the six months preceding the event giving rise to the claim.
- This limitation does not apply to fraud, willful misconduct, gross negligence, death, personal injury and another liability that applicable law does not permit Ridezee to limit.
21. Indemnification
To the fullest extent permitted by law, a rider is responsible for third party claims and reasonable legal costs arising from:
- The rider’s material breach of these Terms.
- Unlawful, fraudulent, willful and reckless conduct.
- Injury, damage and excessive cleaning caused by the rider and guests.
- Unauthorized use of another person’s information and recording.
This responsibility does not apply to the extent the claim was caused by Ridezee’s negligence, willful misconduct and violation of law.
22. Governing Law and Disputes
- Complaints should first be submitted to info@ridezee.com.
- These Terms are governed by the laws of Sint Maarten.
- Subject to mandatory consumer forum rights, the courts of Sint Maarten have exclusive jurisdiction.
- Mandatory consumer protections and privacy rights remain unaffected.
23. Changes and General Terms
Ridezee may update these Terms to reflect service, legal and operational changes.
Material changes will receive any notice required by law. If affirmative acceptance is legally required, Ridezee will request it.
If a provision is unenforceable, it will be limited to the minimum extent necessary. Remaining provisions continue.
Ridezee may assign these Terms to an affiliate and successor, subject to applicable law.
